The principle of preserving the company is the subject of this review, which will be discussed with support in legal theory of business law, the jurisprudence of recent decades and the most recent Brazilian legislation. The objective to be achieved is to demonstrate that principle in its meaning and scope, has a private character of individual interest, and more than that, a public character of social concern that advocates protecting the corporate activity front of a wide variety of situations legal, including those relating to bankruptcy law.
