Abstract

In light of the current political context of reforms to the Consolidation of Labor Laws and the process of privatization of labor relations in Brazil, this research proposes to identify the significance of 'discourses of power' as myths of the labor law discipline. In particular, it deals with the widely spread 'discourse' that the "Consolidation of Labor Law (CLT) is a copy of the Carta del Lavoro (Labor Charter)". The objective of the research was to demystify this premise by means of a comparative analysis between Brazilian and Italian legislation. At the same time, it sought to emphasize the democratic process that went into the construction of workers' legislation in Brazil. The idea that the CLT is 'fascist' is refuted, first because it is untrue and stained with superficiality, and secondly because the supposed authoritarian nature of the legislation that would justify this taint, and consequent need to be radically alterated, has not been corroborated.
