Jurisdição universal na corte internacional de justiça
uma análise sob a perspectiva do cosmopolitismo kantiano

The following work focuses on the case of the former Chadian dictator, Hissène Habré, which generated controversies regarding the issue of the absence of accountability for the individual and also raised the problem of the enforceability of decisions within the scope of international law. In this sense, the article aims to support the idea that Hissène should be tried by the international community, adopting ideas developed by authors on the implementation of the concept of an international community in the punishment of crimes against humanity, engaging in a dialogue with the philosopher Immanuel Kant and the theory of cosmopolitanism. However, upon analyzing how international law is often instrumentalized not for the constitution of an international community, but as an instrument of power and for maintaining the status quo of the so-called Global North, the article adopts a critical perspective on the applicability of cosmopolitanism in the 21st century.
