A COMUNICAÇÃO ENTRE AS ESTRUTURAS JURÍDICAS AMBIENTAL E DE TRÂNSITO QUANTO À POLUIÇÃO ATMOSFÉRICA E SONORA GERADA POR VEÍCULOS AUTOMOTORES TERRESTRES MOVIDOS POR COMBUSTÍVEL FÓSSIL: DIREITOS FUNDAMENTAIS DO MEIO AMBIENTE ECOLOGICAMENTE EQUILIBRADO E DA SA
Abstract
Vehicle pollution – noise or air pollution, for that matter – caused by land motor vehicles powered by fossil fuels is currently one of the great challenges Brazilian cities face when it comes to traffic and sustainable urban mobility, especially when it comes to the maintenance of an ecologically balanced environment and a healthy quality of life. It is well-known that vehicles pollute and this phenomenon highlights the importance of studies that seek to understand the relation between environmental and traffic norms. This research aims to look at the relationship between the environment and traffic, taking into account sustainability and fundamental rights. In this perspective, given the state competence and responsibility to control and supervise this type of pollution with vehicular environmental inspections, this study focuses on the state of Santa Catarina. Having said that, the first chapter will focus on sustainable transport as a factor in maintaining environmental balance and a healthy life quality, while the second chapter will describe legal structures related to the environment and traffic. The third – and last – chapter will address alternatives, more specifically implementing legal frameworks that consider the environment and traffic legal systems while also working towards controlling vehicle pollution. To this end, the theoretical reference will make use of the method of systems thinking, by Fritjof Capra, in which the research will be qualitative in nature, based on bibliographic and documental analysis and historical evolution, also researching laws, resolutions and plans, programs, reports and environmental inventories about this form of pollution. The data analysis will be done according to the comparative and functionalist method, in which the environmental and traffic norms in effect about the theme will be compared, in order to observe any divergences and similarities with the proper communications established. The hypothesis raised – which is confirmed, after all – is that the faulty communication between environmental legal structures and traffic laws harms the environment and worsens life quality, all due to noise and air pollution.
